Robert Bernstein’s request to place an accessory structure in the front yard of his agricultural-residential property at 1387 Dortch Road in Toccoa was listed again for Stephens County Board of Commissioners consideration on May 12. The agenda repeated the Planning Commission’s recommendation to approve the variance, but it did not record whether commissioners took any action.
The case turns on a site-specific exception to the rules governing Bernstein’s parcel, 054A 080. If granted, the variance would allow the proposed accessory structure in a front-yard location; it would not by itself rewrite zoning rules for other property owners in Stephens County.
The request first came before the Planning Commission on April 7, when the agenda identified the front-yard placement proposal, the property’s agricultural-residential zoning and a staff recommendation for approval. The Board of Commissioners is the public body shown on the later agendas considering the request; the agenda materials do not provide a recorded commissioner vote or individual positions.
The Planning Commission’s unanimous approval is a completed, documented action. The April 28 and May 12 Board of Commissioners agenda entries document planned board consideration, not approval or denial. No decision record in this matter establishes whether commissioners granted the variance, rejected it, postponed it or otherwise disposed of it, and the record also does not show that any structure has been built.
The next concrete public step is a Board of Commissioners outcome record, such as minutes, for the April 28 or May 12 meeting. Until one is published or otherwise entered into the official record, residents cannot tell from the agendas whether Bernstein may proceed under a granted variance or whether the request remains unresolved.
